Terms of Service

1. Acceptance of Terms

By accessing or using Decitak ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, please don't use the Service.

2. Description of Service

Decitak is a decision documentation platform that allows teams to document, search, and reference technical decisions. The Service includes:

• Web application accessible via browser
• Decision creation and management (manual entry or AI-assisted)
• AI Decision Assistant powered by Anthropic's Claude (with usage limits per plan)
• Project organization with custom colors and icons
• Search capabilities (keyword search for all plans, AI-powered semantic search for Pro plan)
• Comments and discussions on decisions
• Participants management for decisions
• Share links (Pro plan) - create public links to share decisions
• Export functionality (Pro plan) - export decisions in JSON, CSV, or Markdown formats
• Team collaboration features (Team plan - coming soon)

3. Account Registration

To use Decitak, you must:

• Be at least 13 years old
• Provide accurate account information (email address is required)
• Use secure authentication (we use Clerk for authentication - you're responsible for keeping your account credentials secure)
• Not share your account with others
• Notify us immediately of unauthorized access

You're responsible for all activity under your account. We use Clerk for authentication, and your password is never stored on our servers.

4. User Content & Ownership

You own your content. We claim no ownership over decisions, projects, or other content you create.

By using the Service, you grant us permission to:

• Store and display your content as part of the Service
• Backup your content for disaster recovery
• Process your decision questions through Anthropic's Claude API when you use the AI Assistant feature
• Generate embeddings for semantic search (Pro plan feature)
• Analyze aggregated, anonymized usage data

We will never share your content with third parties without your permission, except as necessary to provide the Service (e.g., sending your decision questions to Anthropic for AI processing, or processing payments through Stripe).

Shared Links: If you create a shared link (Pro plan feature), the decision becomes publicly accessible via that link. You can revoke shared links at any time.

5. Acceptable Use

You agree NOT to:

• Upload illegal, harmful, or offensive content
• Harass, abuse, or threaten other users
• Attempt to hack or disrupt the Service
• Scrape or reverse-engineer the Service
• Use the Service to spam or phish
• Violate any laws or regulations
• Impersonate others or create fake accounts

We reserve the right to suspend or terminate accounts that violate these terms.

6. Plans & Billing

Free Plan

The Free plan is free forever and includes:

• Up to 10 projects
• Unlimited decisions
• 3 AI analyses (one-time, not monthly)
• Keyword search (no AI-powered semantic search)
• Comments and participants

Limitations: Share links and export functionality are not available on the Free plan. We may change limits with 30 days notice.

Pro Plan

The Pro plan ($9/month) includes all Free features plus:

• Unlimited projects
• 50 AI analyses per month
• AI-powered semantic search
• Share links (create public links to share decisions)
• Export functionality (JSON, CSV, Markdown formats)
• Magic Wand feature (progressive AI field generation)

Team Plan

The Team plan is coming soon and will include advanced collaboration features, unlimited AI analyses, and analytics.

Billing Terms

• Billing: Charged monthly via Stripe (annual billing may be available in the future)
• Cancellation: Cancel anytime through the billing settings, no penalties
• Refunds: 30-day money-back guarantee for Pro plan subscriptions
• Price changes: 30 days notice before price increases for existing customers
• Failed payments: Service downgraded to Free plan after 7 days of failed payment
• AI usage limits: AI analyses reset monthly. Unused analyses do not roll over.

7. Service Availability

We aim for 99.9% uptime but don't guarantee uninterrupted service. We may:

• Perform scheduled maintenance (with notice)
• Experience unexpected downtime
• Modify or discontinue features

We're not liable for losses due to downtime.

8. AI Assistant & Third-Party Services

AI-Powered Features

Decitak uses artificial intelligence (AI) powered by Anthropic's Claude API to provide the following features:

• AI Decision Analysis: Automated analysis of your decision questions to generate insights, alternatives, and consequences
• Magic Wand Feature: AI-powered field generation to help you fill in decision forms (Pro plan)
• Smart Tag Suggestions: AI-generated tag recommendations based on your decision content
• Semantic Search: AI-powered search to find decisions by meaning, not just keywords (Pro plan)

By using these AI features:

• Your decision questions, context, and content are sent to Anthropic for processing
• Anthropic's terms of service and privacy policy apply to this data
• AI analyses are subject to usage limits based on your plan
• We store the AI-generated results but not your raw questions after processing
• AI usage resets monthly and unused analyses do not roll over

Third-Party Services

Decitak uses the following third-party services:

• Clerk: Authentication and user management
• Supabase: Database and storage
• Stripe: Payment processing
• Anthropic: AI Assistant feature
• Resend: Email delivery

Your use of these services is subject to their respective terms of service and privacy policies.

9. Data Backup & Loss

While we maintain daily backups:

• We're not responsible for data loss
• You should export important data regularly (Pro plan feature)
• We make no guarantees about data recovery
• AI analysis results are backed up but may be lost if the associated decision is deleted

10. Intellectual Property

The Service, including design, code, and branding, is owned by Decitak Inc. and protected by copyright.

You may not copy, modify, or redistribute the Service without permission.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES
• WE'RE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY IS LIMITED TO AMOUNTS PAID IN THE LAST 12 MONTHS
• AI-GENERATED CONTENT: We are not liable for any errors, inaccuracies, omissions, or consequences resulting from AI-generated content, including but not limited to decision analyses, tag suggestions, field generation, or search results. You assume full responsibility for reviewing and validating all AI-generated content before use.
• THIRD-PARTY AI SERVICES: We are not responsible for the performance, accuracy, or availability of Anthropic's Claude API or any other third-party AI services. Any issues with AI functionality should be reported to us, but we are not liable for third-party service failures or errors.

12. Termination

Either party may terminate:

• You: Delete your account anytime in settings
• Us: Suspend/terminate accounts that violate these Terms

Upon termination, your data will be deleted within 30 days.

13. Changes to Terms

We may update these Terms. Material changes will be notified via email 30 days in advance. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of [Your State/Country]. Disputes will be resolved through binding arbitration.
